Terms and Conditions

1. Promoter
The promoter is Budgy Smuggler Pty Ltd ABN 59 131 294 534 of 9 Orchard Rd, Brookvale NSW 2100, Australia (Promoter).
NSW Trade Promotion Authority Number: TP/04975.
Where required by law, additional permit numbers for other Australian jurisdictions will be published with these terms before the Promotion opens in those jurisdictions.

2. Acceptance of these Terms
By entering the Promotion, each entrant agrees to be bound by these terms and conditions and by the decisions of the Promoter, which are final and binding in all matters relating to the Promotion, subject to applicable law.

3. Promotion Period
The Promotion starts at 12:00am AEST on 1 April 2026 and closes at 11:59pm AEST on 31 July 2026 (Promotional Period). No entries received outside the Promotional Period will be accepted.

4. Eligibility
Entry is open only to:
(a) Australian residents aged 18 years or over at the time of entry; and
(b) persons who make an eligible purchase in Australia during the Promotional Period.
The Promotion is not open to:
(a) residents outside Australia;
(b) purchases made outside Australia, including purchases made through Budgy Smuggler websites or channels servicing the United Kingdom, Europe or any non Australian market;
(c) directors, officers, management, employees and contractors of the Promoter or any agency, supplier or service provider directly associated with the conduct of the Promotion; or
(d) the immediate family members of any person listed in paragraph (c).
For the purposes of these terms, immediate family means spouse, de facto spouse, parent, child, sibling, grandparent, grandchild, whether by blood, marriage, adoption or otherwise, and any person living in the same household.

5. Eligible Products and Eligible Purchase
An eligible purchase is a completed purchase made during the Promotional Period in Australia of Budgy Smuggler products that the Promoter has designated as part of the Budgy Smuggler Winter Collection.
Only the final price actually paid for eligible Winter Collection products counts toward entry calculation. The following do not count toward entry calculation:
(a) shipping, freight, delivery or handling charges;
(b) taxes, duties or similar charges;
(c) gift cards, store credit, vouchers or promo credits;
(d) donations or other non product amounts; and
(e) products outside the designated Winter Collection.
Where a transaction includes both Winter Collection products and non eligible products, only the amount paid for eligible Winter Collection products will count toward entry calculation.

4. How to Enter
Purchase any item from the Budgy Smuggler Winter Collection during the promotional period.
Each eligible Winter Collection item purchased equals one (1) entry into the draw.
For example
• Purchase 1 Winter Collection item = 1 entry
• Purchase 2 Winter Collection items = 2 entries
• Purchase 3 Winter Collection items = 3 entries
There is no limit to the number of entries per person.
Only items designated as part of the Winter Collection qualify.
There is no cap on the number of entries a person may receive, provided each entry is validly earned under these terms.

7. Online Purchases
For an online purchase to qualify:
(a) the order must be placed through the Budgy Smuggler Australian sales channel;
(b) payment must be successfully processed;
(c) the order must not be cancelled, reversed, charged back or flagged by the Promoter as fraudulent, unlawful or in breach of these terms; and
(d) the purchaser must provide valid and current contact details.
Entries from online purchases will be allocated by reference to the eligible product subtotal after discounts and before shipping and other excluded charges.

8. In Store Purchases
For an in store purchase to qualify:
(a) the purchase must be made at a Budgy Smuggler retail store located in Australia during the Promotional Period; and
(b) the customer must provide full and accurate customer details at the time of purchase, including at least their full name and either a valid email address or a valid phone number, and any other information reasonably required by the Promoter to administer the Promotion.
If a customer fails to provide the required details at the time of purchase, or provides incomplete, false or illegible details, that purchase is not eligible and no entry will be recorded.

9. Entry Recording and Verification
The Promoter is responsible for recording entries. The Promoter may verify the validity of entries, entrants and purchases at any time, including by requesting proof of identity, age, residency, purchase, payment, order details, store receipt, or any other document reasonably required to confirm eligibility.
If an entrant cannot provide information reasonably requested by the Promoter within the time specified, the Promoter may, acting reasonably, deem the entry invalid.
The Promoter may refuse to award the prize to a person who has, in the Promoter's reasonable opinion:
(a) breached these terms;
(b) acted fraudulently, deceptively, dishonestly or unlawfully;
(c) manipulated, attempted to manipulate, or interfered with the entry process;
(d) submitted an entry that is incomplete, indecipherable or misleading; or
(e) obtained entries through cancellation abuse, refund abuse, chargeback abuse, system error, or any other process not contemplated by these terms.

10. Returns, Refunds, Exchanges and Order Changes
If all or part of an eligible purchase is cancelled, refunded, returned, reversed or successfully disputed, the corresponding entry or entries attached to that purchase will be cancelled.
If an exchange or adjustment reduces the eligible Winter Collection spend for the original transaction below a full AUD $100 increment, the Promoter may reduce or cancel the corresponding entry or entries.
Examples:
(a) if a customer originally qualifies for 2 entries on an eligible spend of AUD $220 and later returns items so that the final eligible spend becomes AUD $140, the customer will retain only 1 entry;
(b) if a customer originally qualifies for 1 entry on an eligible spend of AUD $120 and later returns items so that the final eligible spend becomes AUD $80, the entry will be cancelled.
Where the prize has already been drawn and an entry is later found to be invalid, the Promoter may, subject to law, withdraw the prize and conduct a redraw or otherwise deal with the prize in accordance with these terms and any applicable permit conditions.

11. Prize
There is one major prize.
The winner may elect one of the following:
(a) one AUD $20,000 travel voucher to be used toward a trip to Japan; or
(b) AUD $15,000 cash.
The maximum total prize pool value is AUD $20,000.
The winner must notify the Promoter of their election within 7 days of being asked to do so. If the winner does not make an election within that time, the Promoter may, acting reasonably, determine that the prize will be awarded as the AUD $15,000 cash option.

12. Travel Voucher Conditions
If the winner elects the AUD $20,000 travel voucher option:
(a) the voucher will be issued by a travel provider or in another form chosen by the Promoter in its discretion, acting reasonably;
(b) use of the voucher is subject to the issuer's terms, conditions, booking rules, expiry rules and availability;
(c) the winner is responsible for any amount above the voucher value;
(d) the winner is responsible for passports, visas, travel insurance, vaccinations, spending money, incidentals, transfers, taxes, levies, and all other ancillary costs not expressly included in the voucher;
(e) travel is subject to airline, supplier and destination availability and any government or supplier restrictions then in force;
(f) no frequent flyer points, loyalty points or similar benefits are guaranteed; and
(g) if any part of the travel voucher is unused, the unused portion is forfeited and is not redeemable for cash unless required by law.
The Promoter makes no representation that the voucher will cover any particular itinerary, travel class, accommodation level or travel dates.

13. Prize Draw
The draw will take place at 10:00am AEST on 5 August 2026 at Budgy Smuggler Pty Ltd, 9 Orchard Rd, Brookvale NSW 2100, Australia, or at another location permitted by law and notified by the Promoter.
The draw will be conducted electronically or by another random method approved by the Promoter and permitted by law.
The first valid entry drawn will win the prize, subject to verification.

14. Winner Notification and Publication
The winner will be notified by phone and or email within 2 business days of the draw using the contact details linked to the winning entry.
Subject to law and any permit requirements, the Promoter may publish the winner's surname, first initial and postcode on the Budgy Smuggler website, social media channels, or both.
If required by law, details of the winner and the result of any redraw will be published in the manner and within the timeframe required by the relevant regulator or permit conditions.

15. Unclaimed Prize
If the prize is not claimed, accepted or successfully awarded within 14 days after the original draw, or if the original winner is found to be ineligible, the Promoter may conduct an unclaimed prize draw.
Any unclaimed prize draw will take place at 10:00am AEST on 20 August 2026 at Budgy Smuggler Pty Ltd, 9 Orchard Rd, Brookvale NSW 2100, Australia, subject to any direction of a relevant regulator or applicable permit condition.
The redraw winner, if any, will be notified by phone and or email within 2 business days of the redraw and, if required by law, their details will be published in the required manner.

16. If the Promotion Cannot Run as Planned
If for any reason any aspect of this Promotion is not capable of running as planned, including because of technical failure, computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, printing error, human error, regulatory direction, pandemic related disruption, force majeure event or any cause beyond the reasonable control of the Promoter, the Promoter may, to the extent permitted by law:
(a) disqualify any entrant involved in interfering with the proper conduct of the Promotion; and
(b) modify, suspend, terminate or cancel the Promotion, or recommence it, as reasonably necessary, subject to any written direction of a relevant regulatory authority.

17. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot lawfully be excluded, restricted or modified.
Subject to the paragraph above, the Promoter and its related bodies corporate, officers, employees, agents and contractors are not liable for any loss, damage or expense, including direct, indirect or consequential loss, arising out of or in connection with:
(a) any late, lost, incomplete, misdirected or illegible entry;
(b) any technical malfunction or network, website, platform or software failure;
(c) theft, unauthorised access or third party interference;
(d) any tax liability incurred by the winner or an entrant;
(e) acceptance, use of, or inability to use, the prize;
(f) any travel, accommodation or other supplier issue relating to the travel voucher option; or
(g) any variation, postponement or cancellation of the prize or any component of it,
except to the extent caused by the negligence, fraud or wilful misconduct of the Promoter or otherwise where liability cannot lawfully be excluded.
If the Promoter is liable to an entrant under any law and the liability can lawfully be limited, the Promoter's liability is limited to one or more of the following, at the Promoter's option:
(a) in the case of goods, replacement of the goods or payment of the cost of replacing the goods; and
(b) in the case of services, resupply of the services or payment of the cost of having the services supplied again.

18. Prize Substitution and No Transfer
The prize is not transferable, exchangeable or refundable, except as expressly stated in these terms or as required by law.
The cash option is fixed at AUD $15,000 and is not negotiable upward in exchange for the winner declining the voucher option.
If any prize component becomes unavailable for reasons beyond the reasonable control of the Promoter, the Promoter may substitute that component with a prize or component of equal or greater value, subject to any written direction of a relevant regulator and applicable law.

19. Taxes and Financial Advice
Any tax, duty or other liability arising from receipt or use of the prize is the sole responsibility of the winner. Entrants should seek independent financial advice if required.

20. Privacy
The Promoter collects personal information in order to conduct the Promotion, verify eligibility, contact entrants, award the prize, comply with legal and regulatory obligations, and as otherwise set out in the Budgy Smuggler privacy policy.
By entering the Promotion, each entrant consents to the Promoter using and handling their personal information for those purposes and disclosing that information to third parties including service providers, regulators, prize suppliers and contractors, where reasonably necessary for the administration of the Promotion or as required by law.
If the requested personal information is not provided, the entrant may not be able to participate in the Promotion or be awarded the prize.
Entrants may access or request correction of their personal information in accordance with the Budgy Smuggler privacy policy.

21. Publicity
By accepting the prize, the winner agrees, if requested by the Promoter, to participate in reasonable publicity connected with the Promotion, including photography, filming, social content and promotional announcements, without further compensation, except where prohibited by law. The Promoter will act reasonably in scheduling and scope.

22. Platform Disclaimer
If the Promotion is advertised or promoted through Meta, Instagram, Facebook, TikTok, Google, Shopify or any other third party platform, the Promotion is in no way sponsored, endorsed, administered by, or associated with that platform, unless expressly stated otherwise. Entrants release each such platform from any liability relating to the Promotion to the maximum extent permitted by law.

23. Governing Law
These terms are governed by the laws of New South Wales, Australia, unless the law of an entrant's place of residence mandatorily applies. Entrants submit to the non exclusive jurisdiction of the courts of New South Wales and any court competent to hear an appeal from those courts.

24. Severability
If any provision of these terms is held to be void, invalid, unlawful or unenforceable, that provision is to be read down to the extent necessary and, if it cannot be read down, severed, without affecting the validity and enforceability of the remaining provisions.
